Estate planning practitioners offer a Health Care Power of Attorney and Living Will among their basic estate planning documents. These most "un-legal" of legal documents can test the patience of any drafter, as trying to ascertain a client's wishes involves a conversation around the client's moral, ethical, spiritual and practical beliefs about the client's eventual death. In addition, many clients and attorneys lack “real world” guidance about how these documents are used in a medical setting.

This CLE program, which includes input from the medical director of palliative medicine at Penn Hospital and an expert in “aging in place,” will address the following:

  • Legalities and realities of appointing a healthcare agent
  • Setting out the client’s wishes in an advance directive or living will
  • The legislative and judicial history in Pennsylvania of the individual's right to choose how they will and will not receive health care

The speakers offer practical guidance regarding healthcare decision-making using illustrative role plays to assist professionals in navigating this extremely important conversation.
